Os magistrados ir\u00e3o decidir se estes incentivos devem ou n\u00e3o integrar a base de c\u00e1lculo do IRPJ e CSLL. \u201cSe a decis\u00e3o do STJ for vencedora, os supermercadistas economizar\u00e3o milh\u00f5es de reais, desde que o processo judicial seja ingressado antes do julgamento\u201d, alerta o advogado tributarista especialista no setor supermercadista, Rafael Mattos.<\/p><p style=\"text-align: justify;\">Isen\u00e7\u00e3o de ICMS, redu\u00e7\u00e3o da base de c\u00e1lculo de ICMS e diferimento s\u00e3o exemplos de incentivos fiscais que ser\u00e3o discutidos no julgamento. \u201cCaso a decis\u00e3o seja favor\u00e1vel aos contribuintes, o setor supermercadista, por exemplo, ter\u00e1 uma economia tribut\u00e1ria t\u00e3o grande que poder\u00e1 ter seu imposto de renda zerado\u201d, explica Rafael Mattos.<\/p><p style=\"text-align: justify;\">Cesta b\u00e1sica e hortifrutigranjeiros s\u00e3o exemplos de produtos que possuem incentivos fiscais de ICMS e representam um percentual expressivo nas vendas dos supermercados. De acordo com Mattos, em decorr\u00eancia da diminui\u00e7\u00e3o de custos de ICMS, gera-se um aumento do lucro fiscal, aumentando expressivamente a carga tribut\u00e1ria na esfera federal. \u201cCaso o STJ mantenha o entendimento adotado em 2017 envolvendo outros incentivos fiscais, o setor supermercadista ter\u00e1 uma vit\u00f3ria importante, eis que, a depender de quanto \u00e9 a sua venda de produtos integrantes da cesta b\u00e1sica e de hortifrutigranjeiros, poder\u00e1 zerar o seu imposto de renda e contribui\u00e7\u00e3o social\u201d, diz o advogado
